While our platform is designed to help you create compliance documentation, it does not guarantee HIPAA compliance. 4. User Accounts

4.1 Account Creation

To use our services, you must create an account. You agree to provide accurate, current, and complete information during registration and to update such information to keep it accurate, current, and complete.

You are responsible for safeguarding your account credentials and for all activities that occur under your account. You must notify us immediately of any unauthorized use of your account.

5. Subscriptions and Payment

5.4 Refunds

Subscription fees are non-refundable except as required by law or as explicitly stated in these Terms. If you cancel your subscription, you will retain access to paid features until the end of your current billing period.

5.5 Free Trial

We may offer free trials for paid plans. At the end of the trial period, you will be automatically enrolled in the free plan unless you choose to subscribe to a paid plan.

6. Acceptable Use

You agree not to:

  • Use the service for any illegal purpose or in violation of any laws
  • Attempt to gain unauthorized access to any part of the service
  • Interfere with or disrupt the service or servers
  • Upload malicious code, viruses, or harmful content

Documents generated by the service based on your input are your property. However, the underlying templates, methodologies, and formatting remain our intellectual property.

We do not warrant that the service will be uninterrupted, error-free, or secure. We do not warrant that the results obtained from using the service will be accurate or reliable.

We do not provide legal, medical, or compliance advice. The service is a tool to assist with documentation and should not be relied upon as a substitute for professional advice.

10. Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY LAW, IN NO EVENT SHALL HIPAA.APP, ITS DIRECTORS, EMPLOYEES, PARTNERS, AGENTS, SUPPLIERS, OR AFFILIATES BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, INCLUDING WITHOUT LIMITATION, LOSS OF PROFITS, DATA, USE, GOODWILL, OR OTHER INTANGIBLE LOSSES, RESULTING FROM:

  • Your use or inability to use the service
  • Any unauthorized access to or use of our servers
  • Any interruption or cessation of transmission to or from the service
  • Any bugs, viruses, or similar issues transmitted through the service
  • Any errors or omissions in any content
  • Any regulatory penalties or fines resulting from your compliance status

Our total liability shall not exceed the amount you paid us in the twelve (12) months preceding the claim.

You agree to defend, indemnify, and hold harmless hipaa.app and its affiliates from and against any claims, damages, obligations, losses, liabilities, costs, and expenses arising from:

  • Your use of the service
  • Your violation of these Terms
  • Your violation of any third-party right, including intellectual property rights

12. Governing Law
